DESTAN GAME
Terms of Use
Draft · legal review pending This text describes how the product works today. Its legal review has not been completed yet, so it is not the final version.
Scope
At present only the Destan Game website and web accounts are open. The game, the DESTAN ONLINE Launcher, the ANADOLU server, Cash, the Store and the Support Center are not open yet, and your account is not linked to a game account or to characters. The parts of these Terms about them apply once they open.
These Terms of Use (the “Terms”) set out the general rules for using the Destan Game website, its account and support areas, the DESTAN ONLINE Launcher and the Destan Game game (together, the “Services”).
The Terms cover the site, accounts, game services, digital content, payments, support areas and the linked platforms officially announced by the Service Provider. The parties to the Terms are the Service Provider and the person who uses the Services; the Service Provider's name and contact address are given in the Privacy Policy.
“Destan Game” is the name of the platform; it is not a company title or a legal entity. The Services are provided, and the obligations in these documents are owed, by the Service Provider identified in the Privacy Policy.
When you create an account, the rules for your account, your Cash and your purchases are also set out in the User Agreement. How your personal data is processed is explained in the Privacy Policy, the entries stored in your browser in the Cookie Policy, payments and refunds in the Refund Policy, and the in-game rules of conduct in the Community Rules.
The privacy notice about your personal data is in the KVKK Information Notice, the rules for protecting your account are in the Account Security and Player Responsibilities document, and sanctions and the ways to appeal them are in the Account Closure, Sanctions and Appeals Policy.
Definitions
In these Terms and in the other legal documents, the following terms have the meanings given below.
- Service Provider
- HAIYUE INTERACTIVE, the publisher of Destan Game, which provides the Services. Its name and contact address are given in the Privacy Policy.
- Destan Game
- The common name of the destangame.com website and of the services offered on it. It is the name of the platform, not a company title or a legal entity. Statements made and commitments given in the name of “Destan Game” in the legal documents are those of the Service Provider.
- Services
- The Destan Game website, the account center, the support areas, the DESTAN ONLINE Launcher, the game client and the ANADOLU server, together with every feature connected to them.
- Account
- The Destan Game account you create to sign in to the Services, identified by a username and an e-mail address.
- ANADOLU and channels
- ANADOLU is the game's server. Channels such as Channel 1 and Channel 2 are layers within that server.
- Cash
- The premium currency used within the Services, which can be spent in the Store.
- Store
- The web store in which in-game products are bought with Cash.
- Payment Service Provider
- The payment institution, separate from the Service Provider, that takes the payment when you buy Cash.
- Support Center
- The support area of the site, through which you can send questions, requests, reports and appeals.
- Virtual item
- Characters, items, in-game currency, Cash and other digital content obtained within the Services.
Accepting the Terms
These Terms are accepted through a separate, explicit act when an account is created: an account cannot be created unless the checkbox on the registration form is checked, and the box is not presented already checked. Merely visiting the site does not mean that you accept the Terms.
With the checkbox on the registration form, you state that you accept the Terms of Use and the User Agreement and that you have read the Privacy Policy; the versions of the texts you accepted and the time of acceptance are recorded with your account. When you buy Cash, you also accept the Terms and the Refund Policy on the checkout page.
For those who visit the site without creating an account, these Terms set out the rules for using the site: the rules on behavior that harms the security and operation of the site apply to everyone.
Having read the privacy notice about your personal data does not mean that you have given explicit consent. Where processing requires explicit consent, your consent is asked for separately from the acceptance of these Terms; agreeing to news and offer e-mails is not a condition of membership.
Membership
When you create an account, the following rules apply; the details of opening, using and closing an account are set out in the User Agreement.
- The details you give at registration must be accurate and must be your own; an account cannot be opened with an e-mail address that belongs to someone else.
- You may not present yourself as another person, an organization or a member of the Service Provider's team.
- You may not access someone else's account without permission or use someone else's sign-in details.
- Your username and your character and guild names must comply with the law and with community order; the naming rules are in the Community Rules.
One person opening more than one account is not a violation in itself and is not, on its own, a reason for a sanction. A sanction is applied when multiple accounts are used to run unauthorized bots, to get around a sanction, to abuse the system or to gain an unfair advantage.
Acceptable use
You may use the Services only for their intended purpose and in line with these Terms. The following is prohibited:
- Endangering the security of the Services, the servers or other users, or trying to get around security measures, request limits or access controls.
- Trying to access someone else's account without permission, or trying to obtain someone else's sign-in details, verification codes or recovery codes.
- Scanning the site or its back-end addresses with automated tools, overloading them, or sending so many requests that the normal operation of the Services is disrupted.
- Modifying or reverse engineering the game client, the DESTAN ONLINE Launcher or the communication between client and server, or running an unauthorized server or proxy service.
- Using cheat software, unauthorized bots, macros and similar unauthorized automation tools; the game's official auto-hunt feature is not covered by this prohibition. The details are in the Community Rules.
- Using the Services for fraud, spam, unsolicited advertising or sharing unlawful content.
- Impersonating employees of the Service Provider, the support team or anyone else.
Accounts and account security
At present your account gives you access to the account center: its security, sessions, notifications and settings. It is not linked to a game account, and the game, Cash, the Store and support tickets are not open yet. The conditions for opening, using and closing an account are set out in the User Agreement.
Do not share your password, the verification codes sent to your e-mail address, the codes generated by your authenticator app or your recovery codes with anyone. To protect your account, you can turn on two-step verification and manage your sessions and devices in the Security Center.
Choose a strong password that you use only for this account; if you suspect that your account has been accessed without authorization, report it without delay. The detailed rules are in the Account Security and Player Responsibilities document.
The Service Provider is obliged to take the technical and administrative measures needed to keep accounts and personal data secure. Incidents arising from the sharing of sign-in details are assessed on the concrete facts; a player's carelessness does not remove the Service Provider's own security and data protection obligations.
Employees of the Service Provider and the support team will never ask you for your password or your codes.
Fair play and equal treatment
The rules of the Services are applied in the same way to every player. No player is given a privilege outside the rules because of their nationality, the country they are in, closeness to the management, friendship, spending or guild ties.
- Sanctions rest on documentable reasons.
- No one on the Service Provider's team may use their position in favor of themselves, people close to them or their guild; abuse of office is prohibited.
- The ethical rules that the management and GM team must follow are set out in a separate section of the Community Rules.
Cheating and abuse
The following behavior is prohibited:
- Using cheat software; tampering with the memory or files of the game client.
- Modifying, imitating or resending the network packets between the client and the server.
- Using unauthorized bots, macros and similar automation tools.
- Knowingly exploiting a bug or vulnerability instead of reporting it.
- Duplicating items or in-game currency; making fake transactions.
- Endangering the security of the server or of other players.
Features that the game officially provides are not covered by these prohibitions. The game's own auto-hunt feature is an authorized feature; using it is not cheating.
No player is given an arbitrary penalty for using a mechanic that the game clearly allows. Whether a violation has occurred is established with concrete evidence and through a reasonable review procedure; this procedure is explained in the Account Closure, Sanctions and Appeals Policy.
Content and intellectual property
The DESTAN ONLINE and Destan Game names, the logo and emblem, the site's original software, its designs and the content prepared by the Service Provider are protected under the intellectual and industrial property legislation in force. These Terms do not give you ownership of any of them.
The rights in game art, characters, music, client software and other works that belong to third parties remain with their respective rights holders; the Service Provider makes no claim of ownership or license over them that is not supported by documents. The registration of a trademark does not, by itself, confer the copyright or publishing rights of another game.
You may install and run the game and the DESTAN ONLINE Launcher only in order to use the Services for personal, non-commercial purposes. Get the installation files from the Download page; files distributed elsewhere are not provided by the Service Provider.
You are responsible for what you write in support tickets, live support conversations and in-game chat. That content is processed to the extent needed to answer your request and to keep the Services secure.
Virtual items and digital rights
Characters, items, in-game currency, Cash and other virtual items obtained within the Services are made available to you under a personal right of use, granted for you to use them within the Services and in line with the rules of the game; the conditions of use are set out in the User Agreement.
This right of use is separate from the rights you have under the law or under a purchase contract: the rules on the right of use do not remove or limit the rights that consumer protection legislation or the purchase contract gives you.
For every digital product offered for real money, its nature, its delivery conditions and any period of use are shown before purchase. The ordinary refund and cancellation rules are in the Refund Policy.
Availability and maintenance
All or part of the Services may be temporarily unavailable because of planned maintenance, updates, technical faults, security incidents, legal necessity, force majeure or problems at infrastructure providers.
Planned maintenance is announced in News. Once the game opens, the status of the ANADOLU server and its channels will be shown on the Server Status page, and known faults on the Known Issues page.
A service that is not connected yet (for example the payment infrastructure or in-game delivery) is clearly shown as “Not connected yet” on the site, and the related action is disabled. The Service Provider never presents a service that is not connected as if it were working.
Changes to the Services
Game balance, content, features and Store products may change over time. Significant changes are announced in News and in the Patch Notes.
Significant changes are announced before they take effect, where possible.
No update or balance change removes your statutory consumer rights or the commercial commitments the Service Provider has previously given explicitly.
Restrictions and termination of access
If these Terms, the User Agreement or the Community Rules are broken, the Service Provider may take measures such as a warning, a temporary restriction, suspension of the account or termination of access. The measure depends on the nature and impact of the violation and on whether it has been repeated.
Depending on the severity of the violation, the sanctions are:
- A written warning.
- A chat restriction.
- Temporary suspension: the account is suspended for a set period.
- Removal of an in-game advantage obtained against the rules.
- Temporary or permanent closure of the account.
Sanctions must be reasonable, consistent and auditable: the same standard is applied to the same violation, and every sanction is recorded together with its reason. The details are in the Account Closure, Sanctions and Appeals Policy.
If you believe a measure was taken in error, you can appeal by writing to the contact e-mail address given in the Privacy Policy.
Support and appeals
You can write about sanctions and actions concerning your account to the contact e-mail address given in the Privacy Policy; once the Support Center opens, support tickets can be opened about sanctions, payment disputes and account actions.
Appeals are reviewed, as far as possible, by a person who did not take the action being appealed. The ways to appeal and the review procedure are explained in the Account Closure, Sanctions and Appeals Policy.
Third-party services
When you buy Cash, you enter your payment details on the Payment Service Provider's own secure payment page, not on this site. That page and the details you enter there are subject to the payment institution's own terms and privacy policy.
The site contains no third-party advertising, tracking or analytics tools.
Liability and disputes
Any limit on the Service Provider's liability applies in accordance with the mandatory rules of Turkish law and only to the extent those rules allow. No provision of these Terms removes or limits the Service Provider's liability arising from intent or gross negligence, or any other liability that cannot be excluded or limited by law.
The statutory rights you have as a consumer cannot be removed or narrowed by these Terms. If a provision of these Terms conflicts with a mandatory rule, the mandatory rule applies.
These Terms are governed by Turkish law. Consumers' right to apply to consumer arbitration committees and consumer courts under the consumer protection legislation in force is reserved; the mandatory rules on jurisdiction and the mandatory consumer protection provisions of the country you are in remain in effect.
Changes to these Terms
The Service Provider may update these Terms to reflect changes to the Services or legal requirements. Every update is published on this page together with the version number and the date of the last update shown at the top. Significant changes are also announced on the site.
Contact
You can send questions about these Terms, and requests about your account, to the contact e-mail address given in the Privacy Policy.
